1. The agreement
These Terms of Service ("Terms") are a binding agreement between you and Xylvin Technologies (OPC) Private Limited ("Xylvin", "we", "us"), a company incorporated in India with its registered office at 277/910, Rajeev Nagar, Mahaveeran Pura, Sipri Bazar, Jhansi, Uttar Pradesh 284003, India, governing your use of the ChitChat mobile application and this website (together, the "Service").
By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use ChitChat.
2. Who may use ChitChat
You may use the Service only if:
- You are at least 18 years old.
- You are able to form a binding contract with Xylvin.
- You are not barred from using the Service under the laws of India or any other applicable jurisdiction.
- Your account has not previously been terminated for breach of these Terms.
3. Your account
You sign in with an email address that we verify using a one-time code. You are responsible for keeping access to that address secure, and for all activity on your account.
Tell us promptly at support@xylvin.com if you believe someone else is using your account. You can review and sign out active devices in Settings.
One person, one account. Do not create an account on someone else's behalf, or impersonate anyone.
4. Acceptable use
You agree not to use ChitChat to:
- Send unlawful, defamatory, obscene, hateful or threatening content, or content that incites violence.
- Harass, bully, stalk or intimidate anyone.
- Share sexual content involving minors, or any content that sexually exploits a child. We report such material to the appropriate authorities.
- Send bulk unsolicited messages, spam, chain messages or automated traffic.
- Infringe anyone's intellectual property, privacy or publicity rights.
- Distribute malware, or attempt to gain unauthorised access to the Service, other accounts, or our infrastructure.
- Reverse engineer, decompile or interfere with the Service, except to the extent that restriction is prohibited by law.
- Scrape, harvest or bulk-collect user data.
- Impersonate any person or misrepresent your affiliation with anyone.
- Break any applicable law, including the Information Technology Act, 2000 and rules made under it.
You can report content or a user from inside the app. We review reports and may act under section 7.
5. Your content
You own what you send. Xylvin claims no ownership of your messages, photos, videos, voice notes, documents or status updates ("Your Content").
You grant us a limited, non-exclusive, royalty-free licence to host, store, transmit and display Your Content strictly to operate the Service — for example, to deliver a photo to the person you sent it to. This licence exists only so that the Service can function, ends when the content is deleted, and does not permit us to use Your Content for any other purpose.
You are responsible for Your Content and confirm you have the rights necessary to send it.
We do not proactively monitor private conversations. We may review content that is reported to us, or where we are required to act by law.
6. Service availability
We work to keep ChitChat available and reliable, but we do not guarantee uninterrupted service. Features may change, be added or be withdrawn. We may suspend the Service for maintenance, and we will give notice where reasonably practicable.
ChitChat is not a replacement for your telephone service and cannot be used to contact emergency services. Use your phone's dialler for emergencies.
Message delivery depends on your network and your device. We are not liable for messages delayed or not delivered because of connectivity, device settings or third-party network failures.
7. Suspension and termination
By you. You may stop using ChitChat at any time and delete your account from Settings → Account → Delete account, or through the web request form.
By us. We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if your use creates risk or legal exposure for Xylvin or other users. Where the circumstances allow, we will tell you why and give you a chance to respond.
Sections 5, 8, 9, 10, 11 and 12 survive termination.
8. Intellectual property
The ChitChat name, logo, application, website and underlying software are owned by Xylvin and protected by intellectual property law. These Terms grant you a personal, non-transferable, non-exclusive, revocable licence to use the app for its intended purpose. Nothing here transfers ownership of anything to you.
9. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the Service will be uninterrupted, secure or error-free, nor that defects will be corrected. Please read the message security section of our Privacy Policy for an accurate description of what our encryption does and does not protect against.
10. Limitation of liability
To the fullest extent permitted by law, Xylvin and its directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or business, arising from or connected to your use of the Service.
Our total aggregate liability for all claims relating to the Service is limited to INR 1,000 or the amount you paid us in the twelve months before the claim, whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for death or personal injury caused by negligence, or for fraud.
11. Indemnity
You agree to indemnify and hold harmless Xylvin against claims, damages, losses and reasonable legal costs arising from your use of the Service, Your Content, or your breach of these Terms or of any law or third-party right.
12. Governing law and disputes
These Terms are governed by the laws of India. The courts at Jhansi, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
Before starting formal proceedings, please contact grievance@xylvin.com — most issues can be resolved quickly.
13. Changes to these Terms
We may update these Terms as the Service develops. For material changes we will give notice in the app or by email before they take effect. Continuing to use ChitChat after that means you accept the revised Terms. If you do not accept them, delete your account.
